By downloading, installing, or using the DigiLaw mobile application or website (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Service.
These Terms constitute a legally binding agreement between you and DigiLaw Technologies Limited ("DigiLaw", "we", "us"). We may update these Terms from time to time; continued use after any update constitutes acceptance of the revised Terms.
DigiLaw is a digital marketplace that connects individuals and businesses ("Clients") with qualified advocates and legal professionals ("Advocates") admitted to the Roll of Advocates of the High Court of Kenya.
DigiLaw provides technology to facilitate discovery, booking, payment, messaging, and video consultations between Clients and Advocates. DigiLaw is not a law firm and does not itself provide legal advice. The legal services are provided solely by the independent Advocates on the platform.
You must be at least 18 years old to use the Service. By using the Service you represent that:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at legal@digilaw.app if you suspect unauthorised access.
You may not create an account on behalf of another person without their express written consent, or use the Service for any unlawful purpose.
DigiLaw verifies that Advocates on the platform hold a valid practising certificate issued by the Law Society of Kenya (LSK). We re-verify credentials periodically. However, DigiLaw does not guarantee the quality, accuracy, or outcome of any legal advice provided by an Advocate, and is not liable for any act or omission of any Advocate.
When you book a consultation, you enter into a direct agreement with the Advocate. DigiLaw facilitates the booking and payment but is not a party to the legal services contract between you and the Advocate.
Consultation fees are set by the individual Advocate and displayed clearly before you confirm a booking. DigiLaw charges a platform fee which is included in the displayed price. All prices are in Kenya Shillings (KES) and inclusive of applicable taxes unless stated otherwise.
We accept M-Pesa and major debit/credit cards via Stripe. Payment is taken at the time of booking. By making a payment you authorise us to charge the stated amount.
Cancellations made more than 24 hours before a scheduled consultation are eligible for a full refund. Cancellations within 24 hours are non-refundable unless the Advocate cancels or does not attend. Refund requests must be submitted through the app within 7 days of the consultation date. DigiLaw's decision on refunds is final.
You agree not to:
Violation of these rules may result in immediate suspension or termination of your account.
All content on the Service — including the software, design, text, graphics, and trademarks — is owned by or licensed to DigiLaw and is protected by Kenyan and international intellectual property laws.
You retain ownership of any content you upload (e.g. legal documents) and grant DigiLaw a limited licence to store and display it solely for the purpose of providing the Service.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy or completeness of any legal advice provided by Advocates through the platform.
To the maximum extent permitted by Kenyan law, DigiLaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, loss of data, or the cost of substitute services.
Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to DigiLaw in the three months preceding the claim.
You agree to indemnify and hold harmless DigiLaw, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You may delete your account at any time through the app settings. We may suspend or terminate your account without notice if we reasonably believe you have violated these Terms. Termination does not affect any rights or obligations that arose before termination.
These Terms are governed by and construed in accordance with the laws of Kenya. Any dispute arising from or in connection with these Terms shall first be submitted to mediation under the Nairobi Centre for International Arbitration (NCIA) Mediation Rules. If mediation fails within 60 days, the dispute shall be finally resolved by arbitration under the NCIA Arbitration Rules, with the seat of arbitration in Nairobi, Kenya.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
